Why is a contract of employment important?
A contract of employment is an agreement between an employer and employee and is the basis of the employment relationship.Most employment contracts do not need to be in writing to be legally valid, but it is better if they are. Employees are legally entitled to a written statement of the main terms and conditions of employment within two calendar months of starting work. This should include details of things like pay, holidays and working hours
A contract 'starts' as soon as an offer of employment is accepted. Starting work proves that the employee accepts the terms and conditions offered by the employer.
Without a contract of employment, there is room for ambiguity, disputes and even potential court action. It is strongly advised that you put a contract of employment between you and your employees as soon as possible after hiring them.
Why do I need a contract with a freelancer?
When engaging independent contractors or freelancers, it can be tempting to review the work you need done, come to an understanding, and get started as quickly as possible. However, oral agreements can be dangerous and lead to legal headaches for both your company and the independent contractor you are working with.
Taking the time to create a written agreement will ensure both you and the independent contractor agree on project details and it will give you the opportunity to establish a strong relationship from the outset.
What’s more, without a written agreement in place that states that the contractor is in fact a contractor and not employee, you or the contractor may be liable to pay more tax than you need to.
